Divorce and Separation

If you are contemplating separation or divorce, we can help.  There are a myriad of legal issues which can arise in cases where married or common law couples separate, including:  

  1. *Custody and access.  Our goal in any custody dispute is to help our clients reach an arrangement which is best for their children.  In most cases, parties can resolve these issues through negotiation, mediation and third party support from professional counsellors.  In circumstances where court intervention is required, we can argue on your behalf in court.

  2. *Child and spousal support.  Whether you are seeking support or being asked to pay support, we can help you ensure that your interests are protected.  This includes ensuring that interim support is being paid immediately after a separation by going to court on an emergency basis if required. 

  3. *Division of Property.  Dividing assets can be complicated, particularly in circumstances where one of the parties is self-employed or has business assets.  We can help by using our network of business evaluators and appraisers to help our clients determine what they are entitled to in a separation. 

  4. *Separation Agreements.   In cases where parties have come to an agreement on their own, we can provide advice and ensure that the agreement is properly recorded.  This is a critical part of the separation process.  We can also advise you if you are being asked to sign an agreement, to help you ensure that the agreement is fair.  We recommend that you come and see us prior to signing an agreement so that you understand both your legal rights and obligations.


Pre-nuptial agreements and Co-Habitation agreements


  1. *Having a properly prepared agreement is important, particularly for individuals with significant assets.  These agreements also help ensure that support and property division expectations are established at the beginning of a relationship so that the parties can avoid difficult and costly disputes if the relationship ends.
